Gary Luftspring, a partner, enjoys a high-level litigation practice. He’s successfully represented clients in a significant and growing number of major cases and was named by Lexpert as a litigator who is “consistently recommended.”
Indeed, Gary is widely regarded among his peers as one of Toronto’s leading litigators dealing with the breakdown of business relationships: In the boardroom, among business owners, for senior management and when complex commercial agreements go awry. He also writes and speaks frequently on corporate insurance issues.
Moreover, Gary is a recognized authority in Canada on officer’s and directors liability insurance, being involved in many major cases creating Canadian law in this complex and evolving area.
“In recent years, the definition of what an officer or director is liable for in a company has been expanding dramatically,” Gary notes. “I’d rather help clients argue cases that set the law than be trying to catch up with it.”
He has appeared as an expert witness in US Federal Court on Canadian procedural and jurisdictional issues, and chaired the annual Canadian conference on Directors and Officers Liability.
Frequently Gary represents senior executives or companies in negotiating new employment contracts, and in pursuing remedies on a client’s behalf when things go wrong.
Other areas of major litigation, trial and arbitral work where Gary has a wealth of experience include complex corporate, commercial and shareholder disputes; executive termination; intricate stock options; non-compete litigation; successor employer obligations; venture capital employee relations; and product liability litigation.
Gary regularly acts as lead counsel in high stakes cases before courts and tribunals including the Ontario Superior Court of Justice, the Divisional Court and the Court of Appeal of Ontario. He has taught trial advocacy and negotiation for the Law Society of Upper Canada Bar Admission Course, and has taught at Osgoode Hall Law School, which is also where he was awarded his law degree.
